VSSTA Terms and Conditions
1. Introduction
These terms and conditions ("Terms") govern your access to and use of the VSSTA Software as a Service ("SaaS") product and services (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
2. Access to the Services
VSSTA grants you a non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes only. You may not use the Services for any other purpose, including but not limited to commercial purposes.
3. Fees
You agree to pay the fees for the Services as set forth in the applicable pricing schedule. Fees are payable in advance and are non-refundable.
4. Payment
You agree to provide VSSTA with accurate and complete billing information, including your name, address, and credit card information. You are responsible for all charges incurred under your account, including any charges incurred by unauthorized users. You agree to promptly update your billing information if it changes.
5. Suspension or Termination
VSSTA may suspend or terminate your access to the Services at any time, for any reason, with or without notice. VSSTA may also suspend or terminate your access to the Services if you breach these Terms.
6. Termination
You may terminate your account at any time by contacting VSSTA. Upon termination, you will no longer have access to the Services.
7. Ownership
All right, title, and interest in and to the Services, including but not limited to all intellectual property rights, are and will remain the exclusive property of VSSTA.
8. Confidentiality
You agree to keep confidential all confidential information of VSSTA, including but not limited to trade secrets, know-how, and financial information. You may not disclose any confidential information to any third party without the prior written consent of VSSTA.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VSSTA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE DEFECTS IN THE SERVICES WILL BE CORRECTED.
10. Limitation of Liability
IN NO EVENT SHALL VSSTA BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR LOSS OF GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICES, EVEN IF VSSTA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.
12. Entire Agreement
These Terms constitute the entire agreement between you and VSSTA with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.
14. Waiver
No waiver of any provision of these Terms will be effective unless in writing and signed by both parties.
15. Notices
All notices and other communications hereunder will be in writing and will be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows: If to VSSTA: VSSTA 502 W. 16. Electronic and Telephone Communications
By providing your email address, phone number, or other contact information in connection with your use of the Services, you consent to receive communications from VSSTA via email, telephone calls, and text messages (SMS/MMS). These communications may include account notices, service updates, billing information, support correspondence, and other information related to your use of the Services. Standard message and data rates may apply to text message communications. You may opt out of text message communications at any time by replying "STOP" to any text message received from VSSTA or by contacting us directly. Opting out of text messages will not affect your receipt of other communications necessary to the administration of your account. You may update your contact preferences or communication information at any time by contacting VSSTA at support@vssta.com

The headings in these Terms are for convenience only and will not affect its interpretation.
18. Counterparts
These Terms may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.
19. Analytics and User Behavior Tracking
19.1 Third-Party Analytics Provider. VSSTA uses PostHog, Inc. ("PostHog"), a third-party product analytics platform, to collect and analyze data about how users interact with the Services. PostHog operates as a data processor on VSSTA's behalf and is contractually required to process data only in accordance with VSSTA's instructions and applicable law.
19.2 Data Collected. When you access or use the Services, PostHog may automatically collect certain usage and behavioral data, including but not limited to: (a) pages and features visited within the portal; (b) clickstream and navigation patterns; (c) session duration and frequency; (d) feature adoption and interaction events; (e) browser type, device type, and operating system; (f) referring URLs and exit pages; and (g) approximate geographic region derived from IP address. PostHog does not collect payment card information, passwords, or the substantive content of your vehicle or estimate records.
19.3 Purpose of Collection. The data collected through PostHog is used solely for internal product improvement purposes, including: (a) understanding which features are most and least used; (b) identifying usability issues and prioritizing improvements; (c) measuring the impact of product updates and new feature releases; and (d) maintaining platform stability and performance. VSSTA does not sell, rent, or share analytics data with third parties for their independent marketing or commercial purposes.
19.4 Cookies and Tracking Technologies. PostHog may set cookies, local storage objects, or similar tracking technologies in your browser to enable session continuity and cross-session user identification. By continuing to use the Services, you consent to the use of these technologies. You may disable cookies through your browser settings; however, doing so may impact the functionality of certain features within the Services.
19.5 User Identification. PostHog may associate usage events with an anonymized or pseudonymized user identifier tied to your account. VSSTA may also instruct PostHog to link this identifier with certain non-sensitive account attributes (such as user role or subscription tier) for segmentation analysis. No directly identifying personal information such as full name, Social Security number, or financial account number is transmitted to PostHog for analytics purposes.
19.6 Data Retention. Analytics event data collected through PostHog is retained in accordance with PostHog's data retention policies and VSSTA's configuration settings. You may contact VSSTA at support@vssta.com to request information about specific retention periods applicable to your account.
19.7 Opt-Out. If you wish to opt out of behavioral analytics tracking, you may: (a) enable a browser-level "Do Not Track" signal where supported; (b) disable JavaScript or cookies in your browser (note: this may impair Service functionality); or (c) contact VSSTA at support@vssta.com to request that your account be excluded from analytics data collection to the extent technically feasible. VSSTA will make reasonable efforts to honor such requests but cannot guarantee complete exclusion from all server-side logging.
19.8 PostHog Privacy Policy. PostHog's collection and processing of data is further governed by PostHog's own Privacy Policy, available at https://posthog.com/privacy. VSSTA encourages you to review PostHog's Privacy Policy to understand how PostHog handles data as a platform.
19.9 California and Other Privacy Rights. To the extent applicable law — including the California Consumer Privacy Act (CCPA) or other state or federal privacy statutes — grants you rights regarding personal information collected through analytics tools, you may exercise those rights by contacting VSSTA at support@vssta.com. VSSTA will respond to verifiable consumer requests within the timeframe required by applicable law.
19.10 Changes to Analytics Practices. VSSTA reserves the right to change analytics providers or expand the scope of data collected for product improvement purposes. Any material changes to this Section will be communicated to users via notice within the Services portal or by email at least fourteen (14) days prior to taking effect. Continued use of the Services after such notice constitutes acceptance of the updated analytics practices.
